1. Introduction and Contracting Party:
These Terms and Policies govern purchases made through the online store operated by A1 GmbH, Am Güterbahnhof 3, 24976 Handewitt, Germany (“the Seller”). By placing an order, the consumer agrees to these Terms and Policies.

2. Scope and Definitions:
A consumer is a natural person acting for purposes not related to trade, business, or profession. An entrepreneur is a natural or legal person acting for commercial or professional purposes. Different rules may apply to entrepreneurs.

3. Formation of Contract:
The presentation of goods in the webshop is not a binding offer. By submitting an order, the consumer makes a binding offer to purchase. Automatic order confirmations do not constitute acceptance. A contract is concluded only when the Seller issues an invoice to the consumer. If technical errors, stock discrepancies, or unavailability occur, the Seller may decline the order before issuing the invoice and will refund any payments already made. The Seller may decline or cancel orders prior to invoicing due to logistical, technical, or security reasons, including suspected fraud.

4. Prices and Payment:
All prices include VAT. Prices shown online are non-binding until confirmed in the invoice. If pricing errors occur, the Seller may correct them before issuing the invoice. Accepted payment methods include credit card, PayPal, and bank transfer. The invoice amount is due immediately unless otherwise stated. If payment fails or is declined, the Seller may cancel the order. Ownership remains with the Seller until full payment is received. All payments are processed via secure, encrypted payment providers. Fraud-prevention checks may delay or prevent order acceptance prior to invoicing.

5. Shipping and Delivery:
Handling time is typically 0–3 business days (Monday to Friday) after the invoice has been issued. Estimated transit time is 0–7 days, depending on destination and carrier. Delivery estimates are non-binding. Shipping costs are calculated at 3%–5% of the product price before discounts, with a minimum charge of €3.95. Available shipping options include Eco Delivery, Standard Delivery, and Prio Delivery. The Seller may adjust the selected carrier or method with a comparable service level if necessary to ensure reliable delivery. Risk transfers to the consumer once the goods are delivered to the consumer or their designated recipient. Freight-forwarder deliveries are made curbside unless otherwise specified. For deliveries outside the EU, the consumer is responsible for customs duties and import taxes. Delays caused by carriers, customs, or external circumstances do not result in liability for the Seller. If the Seller is unexpectedly not supplied by its supplier, despite proper orders, the Seller may withdraw and refund payments. The Seller is not liable for delays or disruptions caused by force majeure.

6. Returns, Exchanges, and Refunds:
The Seller accepts returns of both defective and non-defective products. The return window is 90 days from the day the consumer receives the goods. Items must be returned in new and unused condition, suitable for resale. Using the original packaging is recommended but not required as long as items are packaged securely. Returns may be initiated using the return instructions provided on the Seller’s website or announced via email to customer service. Returns are made by mail, and the Seller provides a free downloadable and printable return label.

Exchanges are accepted for items within the same 90-day window.

For standard (non-defective) returns, a deduction of 3% of the product price is applied to cover the Seller’s reasonable handling, inspection, and prepaid return shipping costs. This deduction does not apply to defective, incorrect, or damaged items. Defective or incorrect items are refunded in full with free return shipping.

Refunds are generally issued within 10 days after the Seller receives the returned goods or receives proof of return. If a parcel is returned due to an incorrect address, refusal of delivery, or failure to collect, the Seller may refund the order minus shipping-related costs or reship the order once the consumer pays the additional shipping fees.

7. Warranty:
Consumers have a two-year statutory warranty under EU law. Warranty claims may be initiated through the process described on the Seller’s website or announced via email. Remedies include repair or replacement; if these are not possible, the consumer may receive a refund or price reduction. Warranty does not apply to normal wear, improper use, accidental damage, or unauthorized modifications.

8. Liability:
The Seller is liable for damages caused by willful misconduct or gross negligence and for injury to life, body, or health caused by negligence. For other damages, liability is limited to foreseeable and typical losses.

9. Additional Provisions:
If any provision is invalid, the remaining provisions remain effective. German law applies. Consumers retain mandatory rights applicable in their country of residence.
